Sec. 506-48. Playing in the Street. No person upon roller skates, or riding in or by means of any coaster, toy vehicles, or similar device, shall go upon any roadway other than the roadway of a play street, except while crossing a highway on a crosswalk. (C.O. 506-48; reordained as C.M.C. 506-48, eff. Jan. 1, 1972) Sec. 505-13. Protective Equipment. (a) Motorized bicycles. (1) No person shall operate a motorized bicycle on a street or highway, or be a passenger on a motorized bicycle, unless wearing a protective helmet on the head, with the chin strap properly fastened, and using safety glasses or other protective eye device. Such helmet, safety glasses, or other protective eye device shall conform with regulations prescribed and promulgated by the Ohio director of highway safety for motorcycles under the provisions of Section 4511.53 of the Revised Code. **2** (2) For purposes of this Section, "motorized bicycle" shall have the same meaning as defined in Section 501-1-M2. (3) For purposes of this Section "street or highway" shall have the same meaning as defined in Section 501-1-S3. (b) Bicycles, Scooters, Skateboards, Roller Skates and In-Line Skates.Ê Ê (1) No person 15 years of age and under shall operate a bicycle, skateboard, or scooter or ride as a passenger on such device, or wear roller skates or in-line skates, within the city of Cincinnati on any public or non-residential property, unless such person is wearing a protective helmet on his or her head, with the chin strap fastened under the chin. Such helmet shall be fitted to the size of the operator and shall meet or exceed the standards set by ANSI (American National Standards Institute), CPSC (Consumer Product Safety Commission), or SNELL (Snell Memorial Foundation). This ordinance shall not apply to any person riding a bicycle, skateboard or scooter as the operator or passenger or wearing roller skates or in-line skates on any property which is a single family residence. (2) No person who is 15 years of age and under shall violate Section 505-13B. (3) The penalty for a violation of this ordinance shall be as follows: a. First offense: written warning; b. Second offense: written warning and the juvenile shall view a safety video within 45 days. Failure to view the video within 45 days shall result in a minor misdemeanor citation; and c. Third and all subsequent offenses: minor misdemeanor. If aggravating circumstances are present, such as a traffic accident or a near accident or there are accompanying criminal or traffic charges against the minor, the officer shall issue a citation rather than a warning. (4) For purposes of this Section "bicycle" shall have the same meaning as defined in Section 50-1-B. (Ordained by Ord. No. 447-1983, eff. Oct. 21, 1983; a. Ord. No. 346-2003, eff. May 1, 2004) Sec. 713-5. Prohibited Uses of Fountain Square Without a Permit. Unless expressly authorized by a permit for the use of Fountain Square issued in accordance with this chapter and the rules and regulations for the use of Fountain Square, it is unlawful for any person or group to do the following: (a) Possess on or bring into Fountain Square any poles, sticks or clubs made of wood, metal, plastic or any rigid material or any other instrument, device or thing that is capable of inflicting serious physical harm, that is designed or specially adapted for use as a weapon or that is possessed, carried or used as a weapon. The prohibitions imposed by this section do not apply to a wooden stick used to elevate or support a sign or banner, provided that such wooden stick is blunt on both ends and is not more than two inches in width or three-quarters of an inch in diameter, one quarter of an inch in thickness, and 40 inches in length. The prohibitions in this section do not apply to canes, crutches or any other similar device used by persons who are visually or physically impaired, nor to law enforcement officers and city employees acting within the scope of their duties. (b) Display, offer for sale or barter, or sell or barter any merchandise on Fountain Square or any public stairway, escalator, passageway or elevator connecting thereto. (c) Use any sound-amplifying equipment on Fountain Square. (d) Play a radio, tape recorder or other electronic sound producing equipment, other than with earphones so that no sound is audible to others. (e) Take any animal onto Fountain Square, unless such animal is being or will be used by law enforcement officials engaged in the performance of their duties, or unless such animal is used as a guide for a disabled individual or such animal is part of a permitted program and is listed on the application. (f) Operate or drive any vehicle, including bicycles, skateboards, roller blades, roller skates or scooters on Fountain Square, except city employees or contractors while engaged in their official or contractual duties. This does not prohibit the use of any motorized wheelchair or any vehicle that is specifically approved as part of a permitted program.
